By accessing and using Esflow Social ("Service"), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use the Service.

Esflow Social is an AI-powered platform that helps users generate, manage, and publish social media content across multiple platforms. Our Service includes:

User Accounts

Account Registration

To use our Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Account Responsibilities

You agree to:

• Provide accurate and complete information during registration
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account
• Comply with all applicable laws and regulations

Account Termination

We reserve the right to terminate or suspend your account at any time for violation of these terms or for any reason at our sole discretion.

Acceptable Use of AI

You are solely responsible for the content generated by Esflow Social. You agree not to use the service to generate:

• Hate speech or discriminatory content
• Misinformation or deliberately false information
• Content that violates community standards of Facebook, X, TikTok, LinkedIn, or Instagram
• Spam, phishing, or manipulated media
• Content intended to automate spam or deceptive practices

We reserve the right to terminate accounts that use our AI to automate spam, violate platform policies, or generate illegal content. You must review all generated content before publishing to ensure it complies with applicable laws and platform policies.

Fair Use Policy for Unlimited AI

The "Unlimited" Guarantee

Esflow Social provides "Unlimited AI Content Generation" on all paid tiers. This means we do not charge you per-token, per-word, or per-request for standard use. Our goal is to empower your creativity without the stress of a ticking meter.

Defining "Fair Use"

To ensure a high-quality experience for all users and to maintain the stability of our infrastructure, "Unlimited" is defined as normal, non-automated human usage. The following behaviors fall outside of Fair Use:

• Automated Scraping: Using scripts, bots, or external tools to programmatically trigger our AI generator.
• Reselling Output: Using Esflow Social as a backend "API-as-a-Service" for other applications or reselling generated posts as a standalone data product.
• Bulk Document Dumping: Uploading thousands of documents in a short window that exceeds typical human reading and scheduling capacity.
• Account Sharing: Sharing a single-user login with multiple individuals to bypass per-seat pricing.

Protective Measures

To prevent system degradation, Esflow Social employs automated monitoring. If your account usage significantly exceeds the 99th percentile of typical professional use, we may:

• Throttle Speed: Temporarily reduce the generation speed of your requests.
• Usage Inquiry: Reach out to you to understand your use case and suggest an Enterprise/High-Volume plan.
• Temporary Suspension: In extreme cases of bot-driven abuse, we reserve the right to suspend access to protect our infrastructure.

AI Ethics & Compliance

Users must not use our AI to generate content that violates the community standards of Facebook, X (formerly Twitter), or other linked platforms. This includes but is not limited to:

• Generating deepfakes or misleading synthetic media without disclosure.
• Systematic generation of misinformation or spam content.
• Content designed to bypass the safety filters of our underlying AI providers (Google Gemini).

General Acceptable Use Policy

You agree not to use the Service to:

• Create content that is illegal, defamatory, obscene, or harmful
• Infringe upon intellectual property rights of others
• Engage in harassment, bullying, or discrimination
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt our Service
• Violate any applicable laws or regulations
• Engage in any fraudulent or deceptive activity

Intellectual Property Rights

Our Content

Esflow Social and its original content, features, and functionality are owned by Esflow Social, its licensors, or other providers of such material and are protected by international copyright, trademark, and other intellectual property laws.

User Content

You retain all rights to the content you upload to our Service. By uploading content, you grant Esflow Social a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content for the purpose of providing the Service.

Generated Content

Content generated by our AI (including post ideas and adaptations) is provided for your use. You are responsible for ensuring that generated content does not infringe upon third-party rights and complies with all applicable laws and platform policies.

Third-Party Integrations

Our Service integrates with third-party social media platforms and services. You are responsible for:

• Complying with third-party terms of service
• Maintaining valid authentication credentials
• Ensuring proper permissions for content posting
• Understanding any limitations or restrictions

Esflow Social is not responsible for third-party service disruptions, policy changes, or content rejection by social platforms.

Service As-Is

Important: AI-generated content may be inaccurate, contain hallucinated facts, or produce unexpected results. Esflow Social does not guarantee the accuracy of generated posts.

You must review all generated content before publishing.

We are not liable for any social media account suspensions, deletions, or penalties resulting from the use of our automated tools or AI-generated content. Each social media platform has its own policies and community standards that may result in account actions independent of Esflow Social's involvement.

Warranty Disclaimer

THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ESFLOW SOCIAL MAKES NO WARRANTIES, EXPRESS OR IMPLIED:

• The accuracy, completeness, or quality of AI-generated content
• Uninterrupted or error-free service
• Fitness for a particular purpose
• Title or non-infringement of third-party rights
• That generated content will not result in account suspension

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ESFLOW SOCIAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING:

• Loss of profits or revenue
• Loss of data or business
• Social media account suspension or deletion
• Reputational harm from AI-generated content

IN NO EVENT SHALL ESFLOW SOCIAL'S TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU IN THE 12 MONTHS PRECEDING THE EVENT OR $100 USD, WHICHEVER IS GREATER.

Billing & Business Information

Esflow Social is a brand and trade name registered in the State of Washington.

Billing Information

Charges on your bank statement may appear as any of the following:

• COMFY LUV

Payment Terms

By selecting a subscription plan, you authorize us to charge your payment method according to the plan terms. We will provide notice of any price changes at least 30 days in advance.

Refunds

Refund policies are subject to applicable law. Please refer to your subscription plan details for specific refund terms.

Confidentiality

We protect your confidential information as described in our Privacy Policy. Any information you provide remains confidential except as required by law.

Indemnification

You agree to indemnify, defend, and hold harmless Esflow Social from any claims, damages, or losses arising from:

• Your use of the Service
• Your violation of these terms
• Content you upload, create, or generate using our Service
• Your violation of any third-party rights or platform policies

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law principles. Any legal action or proceeding shall be subject to the exclusive jurisdiction of the courts in Washington.

Disputes Resolution

If you have any concern or dispute about the Service, you agree to first try to resolve the dispute informally by contacting us at legal@esflow.social.

Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Material changes will be posted at least 30 days in advance. Your continued use of the Service after modifications constitutes acceptance of the updated terms.

Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it valid, or if not possible, severed, and the remaining provisions will continue in effect.

Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Esflow Social regarding the Service and supersede all prior agreements and understandings.
